The surprising part was what she explained in her 17-page explication of her decision. In particular, while Manara's notes include "slapped," the majority of witnesses included Newsome and Birch also used the word "hit" in order to explain what Rice claimed to have said. Manara himself admitted that the portion of his notepads that describes the incident was not "verbatim."

Heather McPhee, the associate general counsel for The associate general counsel, Heather McPhee of the Madden NFL 24PA, also recorded the meeting and put Rice's words in quotation marks. She claimed indicated that Rice had spoken completely. The focus on the pertinent quotation is McPhee's.

Jones quoted one ESPN Radio interview that Birch stated that "we are bound in large part by precedent from prior cases and decisions that have been upheld on appeal in past, and ideas of fairness and appropriateness." In his testimonies, Goodell acknowledged the Madden NFL 24 needed be able to "go back and say, . . . "We are living in a new age, and face different issues and various challenges.'"

The league has proposed changes and a separate policy for players and non-players, but it's not known if discussions were concrete.

According to the current policy, Goodell has the power to hand out punishment as the commissioner sees fit. The Rice incident could have raised issues in this aspect of the policy in instances in which the commissioner could have an agenda or stands accused of deceiving fans and media. "That is a determination they'll need to make and we'll reserve all our rights," Atallah said. "We are extremely disappointed that they've not made a commitment to the negotiation process. The next steps need to be determined."
